These Terms of Use ("Terms") govern your use of the Skipper IQ app (also referred
to as the Powerboat Captain Quiz), on iPhone, iPad and Android ("the App"),
published by Powerboat Training NZ / Powerboat.Training Ltd ("we", "us", "our").
By downloading, accessing or using the App you agree to these Terms. If you do
not agree, do not use the App.

## 1. Training and educational use only — important safety notice
The App and all of its content, tools and features are provided **for training,
educational and general information purposes only.** They are **not** a substitute
for proper seamanship, formal training, official navigation charts and equipment,
weather services, or your own professional judgement as the skipper.
In particular:
- **Anchor Guardian** is an aid to your anchor watch, not a replacement for one.
It depends entirely on your phone's GPS, battery, sensors and manufacturer
settings, any of which can fail without warning. Never rely on it as your only
safeguard against dragging. Always keep a proper anchor watch, especially in
wind, current, or close quarters.
- **Compass, Waypoints, Breakback Boating and the maps** are informational aids
only and must not be used as your primary means of navigation or safety.
- **The Incident Trainer, quizzes and tips** present scenarios and guidance for
learning; they do not guarantee any particular outcome on the water.
You remain solely responsible at all times for the safety of your vessel, your
crew, yourself and others. You must not use the App in any way that distracts
from the safe operation of your vessel. To the fullest extent permitted by law,
we accept no responsibility for any decision made, or action taken or not taken,
in reliance on the App.

## 2. Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable
licence to use the App for your own non-commercial use, subject to these Terms
and the rules of the app store you downloaded it from. You must not copy, modify,
reverse-engineer, resell, sublicense or distribute the App or its content except
as allowed by law.

## 3. Purchases and subscriptions
Some packs and features are available through optional one-time in-app purchases
or a Captain's Club subscription.
- All purchases are processed by **Apple** (on iOS/iPadOS) or **Google Play** (on
Android). We do not see or store your payment card details.
- **Subscriptions renew automatically** at the end of each period (monthly or
annually) unless you cancel at least 24 hours before the end of the current
period. Manage or cancel your subscription in your Apple ID or Google Play
account settings — not through us.
- Prices are shown in the App before purchase and may change over time; any change
will apply to future billing periods only.
- Refunds are handled by Apple or Google under their respective policies. We are
generally unable to issue refunds directly.
- Purchased content remains available for as long as the App and the relevant
service are offered; we may add, change or retire content over time.

## 4. User-generated content (Message in a Bottle)
Message in a Bottle lets you write messages, and reply to messages, that may be
visible to other users of the App ("User Content").
**You are responsible for your User Content.** By submitting User Content you grant
us a worldwide, non-exclusive, royalty-free licence to store, display, distribute
and moderate it for the purpose of operating the community features. You confirm
you have the right to submit it.
**There is zero tolerance for objectionable content or abusive behaviour.** You
must not submit, and must not use the App to send, any content that is:
- offensive, abusive, harassing, threatening, hateful or defamatory;
- sexually explicit, obscene, or harmful to minors;
- unlawful, or that infringes anyone's rights;
- private or personally identifying information about yourself or others;
- spam, advertising, or fraudulent; or
- otherwise inappropriate or unsafe.
To keep the community safe we provide, within the App, the ability to **report**
objectionable content and to **block** an abusive user. Reported content is hidden
from you immediately. We review reports and will remove objectionable content and
may suspend or ban users who breach these Terms. We aim to act on valid reports of
objectionable content **within 24 hours.** We may remove any content, or restrict
or terminate any user, at our discretion.

## 5. Acceptable use
You agree not to: use the App for any unlawful purpose; interfere with or disrupt
the App or its servers; attempt to gain unauthorised access to any part of the
service or other users' data; or use the App in any way that could damage,
disable or impair it.

## 6. Location
Some features use your device's location to work (for example the compass,
waypoints, anchor alarm, Breakback, and Message in a Bottle). How location and
other data are handled is described in our Privacy Policy at
**powerboat-training.co.nz/appprivacy**, which forms part of these Terms.

## 7. Intellectual property
The App and its content — including questions, scenarios, tips, text, graphics,
logos and software — are owned by or licensed to Powerboat Training NZ and are
protected by intellectual property laws. Except for the licence in section 2, no
rights are granted to you.

## 8. Disclaimers
The App is provided **"as is" and "as available"**, without warranties of any
kind, whether express or implied, to the fullest extent permitted by law. We do
not warrant that the App will be uninterrupted, error-free, accurate, or that it
will meet your requirements. Nothing in these Terms limits any rights you have
under the New Zealand Consumer Guarantees Act or other consumer laws that cannot
lawfully be excluded.

## 9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect,
incidental, special or consequential loss, or for any loss of or damage to
property, vessels, or personal injury, arising out of or in connection with your
use of, or inability to use, the App or your reliance on it. Where liability
cannot be excluded but can be limited, our total liability is limited to the
amount you paid for the App (if any) in the 12 months before the claim.

## 10. Termination
We may suspend or end your access to the App or its community features at any time
if you breach these Terms. You may stop using the App at any time by deleting it.
Sections that by their nature should survive termination (including sections 1,
7, 8, 9 and 11) will continue to apply.

## 11. Changes to these Terms
We may update these Terms from time to time as the App changes. The latest version
will be made available in the App or on our website, and your continued use of the
App after a change means you accept the updated Terms.

## 12. Governing law
These Terms are governed by the laws of New Zealand, and the New Zealand courts
have non-exclusive jurisdiction, without affecting any mandatory consumer
protections available to you where you live.

## 13. App store terms (Apple and Google)
These Terms are between you and us, not with Apple or Google. Apple and Google
are not responsible for the App or its content, and have no obligation to provide
any maintenance or support for it. To the extent the App is obtained through the
Apple App Store, you acknowledge that Apple and its subsidiaries are third-party
beneficiaries of these Terms and may enforce them against you. Your use of the App
must also comply with the applicable App Store or Google Play terms of service.
